Affirmative Action and Reservations – The Missing Links

The recent reservation debates, while drawing comparisons with Affirmative Action (AA) of USA, fail to highlight the proactive facet of AA. AA is superior to our reservations both in letter, spirit and scope. While the Indian reservation system extends to the Government sector alone, the historic Executive Order 11246 issued by President Lyndon Johnson covers almost 200,000 government contractors and sub-contractors.

This article, while quoting Adarand Constructors v. Pena fails to inform the background of the case. The case challenged one of the remarkable components of AA, the minority set-aside programs. These require the Federal, State and Local Governments to set aside a percentage of funds exclusively for minority contractors. Such provisions are glaringly missing in our reservation system. Public Works Employment Act, 1977, which was the first legislation to implement set aside programs, was challenged in the Supreme Court by white contractors and the Supreme Court upheld the law in Fullilove Vs Klutznick. Sadly, the Bhopal Declaration, which touted for such measures, hibernates in the UPA's Common Minimum Programme.

On the AA front, the Supreme Court of USA has played a pioneering role upholding it and ensuring that it is followed in various aspects inter alia education, recruitment, entrance tests etc. Some of them deserve a mention here.

The Regents of the University of California v. Bakke, in addition to ruling in favour of racial preference for disadvantaged groups, also held that “the goal of achieving a diverse student body is sufficiently compelling to justify consideration of race in admissions decisions” and that being a minority group could “be deemed a plus in a particular applicant’s file”. Unfortunately, in India, instead of recognizing the role reservation in ensuring diversity, it is treated as a sop to the deprived classes.

In the United States v. Paradise, the Supreme Court upheld the District Court for the Middle District of Alabama’s rulings with regard to discrimination in the employment of black trooper. In 1972, the court ordered to hire one black trooper for every white trooper till the percentage of black trooper reaches 25, when it found that in the past 37 years not even a single black trooper was recruited. After 11 years, when the District Court found that the progress had been tardy, it followed up with the order of promotion of one black trooper for each white trooper elevated in rank. On the contrary, in India, most of the reservations go unfilled and administratively get reclassified as “Backlog Vacancies”.

On the issue of entrance tests for employment purposes, the U.S Supreme Court, in the Griggs v Duke Power Company (1971), ruled that the Civil Services Act banned discriminatory employment practices that cause exclusion of disadvantaged groups, when it cannot be shown that those practices relate to job performance. The employment practices include intelligence tests and minimum education qualifications. Further, to ensure that the practices followed relate to job performance, the court ruled that the correlation between high scores in tests and high job performance must be shown by the employers.

In Albemarle Paper Company Vs Moody (1975), the Supreme Court ruled that culturally biased tests were illegal even if the employer was not discriminating intentionally. In Connecticut et al Vs Adele (1982), the same court said that using culturally biased tests were illegal even if the state promoted more blacks than whites. Infact, till the Civil Services Act, 1991 was passed, most recruitment processes followed a practice called Race Norming where additional marks where awarded to the minorities to offset the cultural bias in the tests. In sharp contrast, glaring cultural biases like testing English vocabulary in exams like CAT and predominant usage of English as the medium of tests have gone unchallenged in our country where most of the disadvantaged students are tutored in vernacular medium.

Such comprehensive and detailed implementation of Reservations is sorely missing in India. Yes, we can’t compare AA with reservations. They have a far wider, deeper and more honest reach.

well, not much much research went into this. i found this in one of my text books which spoke of personnel administration in american government. I just googled for finer details of the cases and your cornell law school maintains a wonderful compilation of landmark judgements in simple and abridged form. so it is more of sharing.

Their program is backed by honest intent, is monitored for effective use, and data is made publicly available.

A childs future is precious, it is the states responsibility to ensure that every seat denied to a child under the scheme reaches the exact beneficiaries. Close and aggressive monitoring is a must.


Instead, we have the top minister of the country going all out to *avoid* giving us even basic data. It has been decades since any study has been done in both your state and in TN/KE/KA.

Rajiv Gandhi said that for every one rupee spent only 15 paise reaches the beneficiaries. i.e 85 paise is lost to politicians, bureaucrats, businessmen. So would you ask for scrapping of all poverty allevation programs?

Does the government have data on the subsidies given to industrialists, the tax evaded by rich using farm houses, eviction on rehabilitation (if any) of dam/industrial project oustees, etc?

But there are no protests, no lethal medical strikes, no noise on the blogosphere, no personal attacks and character assassinations, no painstaking reproduction of TV transcripts.

As said before, I dont reject the need for a study. But that should not be the only reason for opposing OBC reservations

Two things:

1. The need for reservations is right, but communicating to the people that they have reservation is more important. THis week, a guy related a story where his washerman didnt even realise he had reservation and would naturally lose out on his reservation
2. Secondly isnt it time you come up with more concrete proposal on the way it has to be implemented. Give a justification on how AA could be employed in India. I am free for some time and we can come up with a draft type and forward it across mails and reduce the blogosphere noise
3. Why this obsession with serious stuff...you have just finished exam and it is time for some fun...

I know my counting is wrong...but that is what is good about it

Finally how about a good afty drink. Give me a call tonite

What you are saying is because there is injustice in other systems, it is ok to do this. This would only lead to a vicious circle-

Next time someone affected by a dam demands a study regarding benefits of a dam before building it, all he would get is -Let's build the dam and then study the effects later-

The thing is at some point of time you have got to stop and say -Let's study the result first and then implement it. You can't rectify the past but why don't you do it for any future proposal (especially controversial ones be it reservations or dams). Same with poverty alleviation schemes-The fact that they did not work in the past means don't introduce new ones blindly....

Are these doctors meritwallahs or from depressed classes?
Why the so-called upper caste merit wallahs doctors turned out to be devils ? We dont say depressed people cant do it, but till date none has been found in this racket.
This racket clearly shows why the doctors dont want to expand medical education ?
There is huge money in this profession which has become synonymous with dalali, anything can be fixed for money?



The IMA must tell why merit wallahs were found doing this, as it feels that they are the upholders of hippocrates oath in this country. The IMA itself is is battleground of corruption and sleaze, and there are many more skeletons in the cupboard.

New Delhi: After CNN-IBN and DIG exposed doctors who cut off beggars' limbs for a price to help the beggar mafia the Indian Medical Association (IMA) has promised to prosecute the erring doctors.


Dr Ajay Kumar, National President Elect of the Indian Medical Association has said that the doctors will be arrested immediately.


"If they are registered with the IMA then their medical license will be immediately suspended," he said.

The police have already taken Dr P K Bansal for questioning. He runs a clinic named Orthomat in Delhi's Old Rajinder Nagar locality.


Dr Bansal had agreed to amputate the limbs of a beggar despite knowing that the law prohibits amputation by will.


Another doctor, Ghaziabad-based Ajay Agarwal took money to amputate healthy limbs of a DIG investigator who posed as a prospective beggar.


People entered Agarwal's house in Ghaziabad and demanded action against the erring doctor.


In a sting operation, a team of CNN-IBN reporters exposed orthopaedic surgeon Ajay Agarwal's unethical practice.


Dr Agarwal put the fake beggar through a series of medical tests at his nursing home.


The surgeon pocketed Rs 4,000 as advance for the operation from the team while also giving advice on how the amputation could be made to look legal.


When CNN-IBN reached Dr Ajay Agarwal at the Noida Civil Hospital, the cameraperson was pushed and abused.


It was in fact Dr Ajay Agarwal who had referred Dr P K Bansal to the investigative team as part of amputation nexus.


Dr Ajay Agarwal is absconding and the police are trying to track him down.

CNN-IBN had also exposed Dr Arvind Agarwal of Bareilly.


Dr Agarwal, who is also the Secretary of the Orthopaedic Association of Bareilly is now absconding.


His wife says he has not returned since Saturday afternoon.


When questioned about Dr Agarwal, his wife, Dr Neera Agarwal said,”If he has not come then how can I tell you?”


The police are now looking out for him. The Senior Superintendent of Police (SSP), Bareilly, Anand Swaroop said, "We are looking for him and have contacted IMA for cooperation."
